These TOS are between Surfnerd B.V., Hoeveneind 60, 4847NG Teteringen, Netherlands (“Surfnerd”, “we”, “us”) and you, the natural person visiting or using Surfnerd (“you”, “User”).
You must be at least 16 years old. One human per account. Keep your password secret; you’re liable for all activity.
You may sign up using your email or third-party login providers like Google or Apple. When using these, you authorize us to access your email address to create or link your Surfnerd account. Use of third-party logins is also governed by their respective terms.
Prices include VAT where applicable. Payments are processed by Stripe; their terms apply. If a charge fails, we may suspend Plus until settled.
We grant a limited, revocable, non-transferable license to access Surfnerd for personal, non-commercial surfing-related purposes.
You retain ownership of photos, comments, and data you upload (“User Content”). By posting, you give us a worldwide, royalty-free license to display and distribute it only to operate Surfnerd. You promise you have the rights and that it’s legal and non-infringing.
No scraping, reverse engineering, cheating, botting, harassment, hate speech, or illegal activity. We may remove content or ban you at our discretion.
All Surfnerd software, branding, and original materials are ours or our licensors’. All rights reserved.
We strive for 24/7 uptime but do not guarantee it. Features may change or be discontinued. We’re not liable for outages or data loss beyond mandatory consumer-law remedies.
Surfing is risky. Content is informational only. Always check local conditions. Use at your own risk. Max liability: fees you paid us in past 12 months.
You agree to defend and hold Surfnerd harmless from claims arising out of your misuse or violation of these TOS.
These TOS apply while you use Surfnerd. You may delete your account any time. We may suspend or terminate for breach. Clauses 6, 8, 10–14 survive.
Dutch law applies. EU consumers may use the ODR platform. Competent court: Breda District Court.
We’ll post updates at least 14 days before they take effect. Continued use means acceptance.
